Summer Camp Information

MVTC 2022 Summer Camp runs from 9am to 3:30pm Monday-Friday .

Lunch is included and Campers get to choose their lunch items each day.

Tennis takes place all morning and part of the afternoon.

Afternoon Pool: Tennis Campers get access to the pool with monitored free swim .

ASSUMPTION OF RISK HOLD HARMLESS AND RELEASE AGREEMENT FOR SUMMER CAMP

Assumption of Risk:  As parent or legal guardian of participant, I am aware that the Activity involves inherent risks, dangers, and hazards that can result in serious personal injury or death.  I am also aware that the Club facilities and/or equipment contain dangers and can cause serious injury or death.  I and participant hereby freely agree to assume and accept all known and unknown risks of injury arising out of the Activity including injury or death that results from Club’s negligence, design of the facility and/or equipment, or from any third party.

Insurance Release and Indemnity:  In exchange for the Club allowing participant to participate in the Activity, I and participant understand and expressly acknowledge that we, on our own behalf and on behalf of the other members of our family, including spouse, parents, children, heirs, and assigns, release and indemnify the Club, its parent company, affiliated or subsidiary companies, and all their respective officers, directors, agents, contractors, employees, heirs, successors, assigns, volunteers and guests from all liability for any injury, loss or damage connected in any way whatsoever to participation in Activity that may result from Club’s negligence, design of the facility and/or equipment, or from any third party, whether on or off the Club’s premises and including any transportation. I agree to make the club an additional insured for participant’s activities in this summer camp program

Waiver of Civil Code Section 1542: I and participant and the Club further acknowledge that the terms of this Agreement have been negotiated and agreed upon after considering the possibility of discovering facts other than, or different from, those which the Parties now know or believe to be true with respect to the subject matter covered by this Agreement, and the Parties intend to fully, release any all claims, known or unknown, suspected or unsuspected, contingent or non-contingent. Therefore, the Parties hereby expressly waives any rights such may have in any claims, which now exist, or heretofore have existed upon any theory of law or equity now existing (or coming into existence in the future), without regard to the subsequent discovery or existence of such different or additional facts, and specifically and expressly waives all right or benefits that the Parties now have, or in the future may have, under California Civil Code section 1542, which provides as follows: A GENERAL RELEASE DOES NOT EXTEND TO THE CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM OR HER MUST HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR.

Property Loss:  All personal property brought to the activity is brought at the sole risk of the participant as to its theft, damage, or loss. I and participant hold the club harmless for any theft, damage, or loss of stolen property.

Medical: I give my consent to emergency medical care and transportation in order to obtain treatment in the event of injury, as the Club may deem appropriate. 

Severability:  Any provision or portion of this Assumption of Risk, Hold Harmless and Release found to be invalid by the courts having jurisdiction shall be invalid only with respect to such provision or portion.  The remaining provisions or portion hereof, shall be construed and enforced to the same effect as if such offending provision or portion thereof had not been contained herein.

Mill Valley Tennis Club Covid-19 Assumption Of Risk, Waiver Of Liability And Hold Harmless Agreement

In consideration for receiving permission to be on the premises, and/or using the courts or swimming pool areas at the MILL VALLEY TENNIS CLUB (hereinafter the “Activity or Activities”), I, on behalf of myself and any minor child/children for whom I have the capacity to contract, hereby acknowledge and agree to the following:

  1. I, on behalf of myself and any minor child/children for whom I have the capacity to contract, understand the hazards of the novel coronavirus (“COVID-19”) and am familiar with the Centers for Disease Control and Prevention (“CDC”), California State and County of Marin rules and guidelines regarding COVID-19. I acknowledge and understand that that the circumstances regarding COVID-19 are changing from day to day and that, accordingly, the above guidelines are regularly modified and updated, and I accept full responsibility for familiarizing myself with the most recent updates.
  2. Notwithstanding the risks associated with COVID-19, which I readily acknowledge, I, on behalf of myself and any minor child/children for whom I have the capacity to contract, hereby willingly choose to participate in Activities at the MILL VALLEY TENNIS CLUB, and expressly assume any and all risks associated with participation in such Activities.
  3. I, on behalf of myself and any minor child/children for whom I have the capacity to contract, acknowledge and fully assume the risk of illness or death related to COVID-19 arising from my being on the premises and participating in the Activities and hereby RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE (on behalf of myself and any minor children form whom I have the capacity contract) the MILL VALLEY TENNIS CLUB, its officers, directors, agents, employees and assigns (the “RELEASEES”) from any liability related to COVID-19 which might occur as a result my or my children being on the premises and participating in the Activities.
  4. I, on behalf of myself and any minor child/children for whom I have the capacity to contract, shall indemnify, defend and hold harmless the RELEASEES from and against any and all claims, demands, suits, judgments, losses or expenses of any nature whatsoever (including, without limitation, attorneys’ fees, costs and disbursements, whether of in-house or outside counsel and whether or not an action is brought, on appeal or otherwise), arising from or out of, or relating to, directly or indirectly, the infection of COVID-19 or any other related illness or injury.
  5. It is my express intent, on behalf of myself and any minor child/children for whom I have the capacity to contract, that this Waiver and Hold Harmless Agreement shall bind any assigns and representatives, and shall be deemed as a RELEASE, WAIVER, DISCHARGE, AND COVENANT NOT TO SUE the above-named RELEASEES. This Agreement and the provisions contained herein shall be construed, interpreted and controlled according to the laws of the State of California.

IN SIGNING THIS AGREEMENT, I ACKNOWLEDGE AND REPRESENT THAT I have read the foregoing

Wavier of Liability and Hold Harmless Agreement, understand it and sign it voluntarily as my own free act and deed; no oral representations, statements, or inducements, apart from the foregoing written agreement, have been made; I am at least eighteen (18) years of age and fully competent; and I, on behalf of myself and any minor child/children for whom I have the capacity to contract, execute this Agreement for full, adequate and complete consideration fully intending to be bound by same.
